These Terms of Service establish the framework for accessing and utilizing TrustWise, a private trust creation and management platform operating as an auxiliary of Endogon Earth Trust, a Private Membership Association (PMA) and faith-based organization. TrustWise operates exclusively within private jurisdiction under principles of equity and natural law.

Nature of Service
Private Jurisdiction Operation
TrustWise operates as a private trust entity and auxiliary of Endogon Earth Trust, a Private Membership Association. All services are provided within private jurisdiction, governed by principles of exclusive equity, natural law, and common law maxims. We do not operate under statutory jurisdiction or provide services subject to government regulation or oversight.
Educational and Facilitation Services
TrustWise provides:

What We Are NOT

- We do not handle trust assets or act as corporate trustees
Membership and Access
PMA Affiliation Requirement
Access to TrustWise services requires affiliation with Endogon PMA or acceptance of membership terms. By using TrustWise, you acknowledge:
- Your understanding of the distinction between private (lawful) and public (legal) jurisdiction
- Your voluntary choice to act as a Natural Person within private jurisdiction for trust matters
- Your acceptance of exclusive equity principles as the foundation for trust governance
- All monetary transactions with Endogon or Trustwise are considered Contributions to a private not-for-profit entity, regardless of "Payment" terminology.
Account Creation
When you create an account with TrustWise:
- You affirm that you are of legal age and capacity to enter into private agreements
- You agree to provide accurate information during account setup
- You understand that your account grants access to trust creation and management tools
- You accept responsibility for maintaining the confidentiality of your account credentials
Subscription Plans
TrustWise offers various subscription tiers providing different levels of access to features, storage, and AI assistance. Subscription terms, pricing, and features may be modified with notice to members. Payment processing is handled through secure third-party providers operating under contractual agreement with TrustWise.

You understand that:

- You must adapt documents to your specific circumstances
- Document generation does not create a trustee-beneficiary relationship with TrustWise
- You retain full responsibility for trust administration

Access to comprehensive educational materials including:

- Exclusive equity maxims and interpretations
- Trust administration guidance
- FAQ and reference documentation
User Responsibilities
Accurate Information
You agree to:
- Provide truthful and accurate information during trust creation
- Update your trust profiles as circumstances change
- Notify TrustWise of any errors or issues with generated documents
- Maintain accurate contact information
Appropriate Use
You agree to use TrustWise services only for:
- Creating and managing lawful private trust structures
- Educational purposes regarding trust law and equity principles
- Personal or family trust administration
- Activities consistent with exclusive equity and natural law
You agree NOT to:
- Use services for illegal purposes or statutory trust creation
- Attempt to circumvent platform security or access controls
- Share account credentials or access with unauthorized parties
- Use automated systems to access or scrape platform content
- Misrepresent the nature of TrustWise services to third parties
Trust Administration
You acknowledge that:
- TrustWise facilitates document creation but does not administer trusts
- You or your appointed trustees bear full fiduciary responsibility
- Proper trust administration requires ongoing attention and expertise
- You should seek appropriate advisors for complex trust matters
Intellectual Property
Platform Content
TrustWise retains ownership of:
- Platform software, interfaces, and AI systems
- Educational content and knowledge base materials
- Templates, frameworks, and methodological approaches
- Branding, trademarks, and proprietary information
User-Generated Content
You retain ownership of:
- Information you provide during trust creation
- Customizations and modifications to generated documents
- Data stored in your trust profiles
You grant TrustWise a limited license to:
- Process your information for document generation
- Store data for platform functionality
- Use anonymized, aggregated data for platform improvement
Confidentiality
TrustWise commits to:
- Maintaining confidentiality of your trust information
- Not sharing your data with third parties except as required for platform functionality
- Implementing reasonable security measures to protect your information

Disclaimers and Limitations
No Professional Relationship
Use of TrustWise does not create:
- An attorney-client relationship

Service Availability
TrustWise strives for continuous service availability but:
- Does not guarantee uninterrupted access

- May modify features or interfaces with notice
- Reserves the right to discontinue services with appropriate transition period
Limitation of Liability
To the fullest extent permitted under principles of equity and natural law:
- TrustWise is not liable for indirect, consequential, or incidental damages
- Maximum liability is limited to fees paid for services in the preceding 12 months
- You acknowledge voluntary assumption of risk in using AI-assisted tools
- You waive claims arising from your own errors, omissions, or failure to seek appropriate guidance
Termination and Account Closure
Voluntary Termination
You may terminate your TrustWise account at any time by:
- Requesting account closure through account settings or support
- Providing notice of your intent to discontinue services
- Settling any outstanding subscription fees
Upon termination:
- You retain copies of any documents you have downloaded
- TrustWise will cease processing charges for subscription services
- Your data will be handled according to our Privacy Policy retention terms
Involuntary Termination
TrustWise may suspend or terminate accounts for:
- Violation of these Terms of Service
- Abusive, fraudulent, or illegal conduct
- Non-payment of subscription fees
- Misrepresentation of the nature of our services
Dispute Resolution
Private Jurisdiction Resolution
Consistent with operation within private jurisdiction:
- Disputes will be resolved through private arbitration or mediation
- You agree to exhaust good-faith negotiation before formal proceedings
- Resolution will be governed by principles of equity and natural law

General Provisions
Entire Agreement
These Terms, together with our Privacy Policy, constitute the complete agreement between you and TrustWise regarding platform services.
Severability
If any provision is found unenforceable, remaining provisions continue in full force and effect.
No Waiver
Failure to enforce any provision does not constitute waiver of future enforcement rights.
Private Jurisdiction Governance
These Terms are governed exclusively by principles of equity, natural law, and common law maxims. We operate outside statutory jurisdiction and do not invoke or consent to statutory court oversight.
